Enterprise Zone Proposals
SUMMARY OF PROCEDURE FOR ENTERPRISE ZONE PROPOSALS
Any business seeking tax incentive benefits under the Ohio Enterprise Zone Program in the City of West Carrollton, Montgomery County Ohio, must enter into a negotiated Enterprise Zone Agreement with the City of West Carrollton and Montgomery County. The Agreement is the legal contract which outlines the responsibilities and expectations of both the business and community.
The following is a summary of the steps for review and approval of an Enterprise Zone Agreement in the City of West Carrollton:
1. Pre-application Conference. - Although not required, applicants are encouraged to meet with the Enterprise Zone Manager prior to submitting a formal Enterprise Zone proposal. The purpose of this meeting is to review the application process, the eligibility of the proposed project, identify special information which may be required, time frames, etc.
2. Formal Proposal - Submit a formal proposed agreement for enterprise Zone Tax Incentives on forms supplied by the City of West Carrollton. This proposal must be accompanied by a one-time $750.00 application fee. This fee is payable through check or money order made payable it the Ohio Department of Development. According to State Law, applications cannot be processed without this fee.
3. Negotiation - Upon submission of a formal Enterprise Zone proposal, a three (3) person negotiation team, in discussions with the business, will evaluate the acceptable level and term of tax incentives which are relevant to the successful implementation of the proposed project. This team consists of the Enterprise Zone Manager, City Manager (or designee) and Superintendent (or designee) of the appropriate school district. If the negotiating team is able to develop an acceptable package considered to be favorable to the City, they will make a formal recommendation to City Council concerning the Final Enterprise Zone agreement.
4. School and Relocation Notifications - A minimum of 14 days prior to the date that City Council reviews and takes action on the Final Enterprise Zone Agreement, a copy of the application and draft agreement must be delivered to the affected school board for comment and notified of the time a date of the meeting at which the proposal will be reviewed. A minimum of 30 days notification is required in those instances where a tax incentive of greater that the limit of 75% limit is proposed.
5. City Council Action - After expiration of the required notification times, City Council may approve the project and authorize the City Manager to sign the Final Enterprise Zone Agreement.
6. School and Relocation Notifications - A minimum of 14 days prior to the date that the Montgomery County Commissioners reviews and takes action on the Final Enterprise Zone Agreement, the school board must again be notified in the same manner as for review by the City Council.
7. Montgomery County Commission Action - After expiration of the required notification time, the Montgomery County Commission may approve the project and authorize execution of the Final Enterprise Zone Agreement.
8. State of Ohio Review - Within 15 days of executing the agreement, a copy must be forwarded to the Ohio Department of Development (ODOD), Ohio Department of Taxation and the Montgomery County Auditor.
